Guns and the mentally ill?I was looking at the basic gun laws for each state and noticed NY says you can't buy a handgun if you have ever suffered any mental illness

Does this mean a 28 year old woman wouldn't be allowed to own a handgun because she suffered from postpartum depression when she had a kid at 18?

Does this mean if someone, as a child, is diagnosed with the popular ADHD (Attention Deficit Hyperactivity Disorder), which occurs in up to 10% of the population accoding to the National Institutes of Health, they're not allowed to own a handgun in NY?

Does this mean if someone suffers from one of the many anxiety disorders, such as Acrophobia (fear of heights), Claustrophobia (fear of confined spaces), Arachnophobia (fear of spiders), that they're not allowed to own a handgun in NY? A study by the National Institute of Mental Health found that up to 18% of the population suffers from these types (phobias) of anxiety disorders and are the #1 most common mental illness for women, #2 for men over 25.

About half of this country are on anti-depressants.

The restriction on people with mental illness usually applies to people who have been in mental hospitals, not those treated by their physcians for minor psychiatric illnesses.

You are beginning to learn about "back door" gun control.
Now figure every person who has a phobia of spiders who gets busted owning a gun or gets denied a purchase now gets listed by the gun hating side as ONE more mentally ill person kept from a weapon when in reality the numbers are all bullshit.

they want to take away every ones right to own a gun but they don't want you to know they are doing it. It is the same with felonies, make more and more things felonies and take away more and more gun rights.

Cite the relevant section of NY law, if you can.

When you fill out the BATF form 4473, there is a yes/no question which reads,in part:

"Have you ever been adjudicated mentally defective (which includes having been adjudicated incompetent to manage your own affairs) or have you ever been committed to a mental institution?"

SO - if your question meets the criteria listed, then you would be denied. The key word in the BATF question is "adjudicated ". Just being afraid of something is not enough.

Anybody who wants to get a gun can get one, this is America. I don't care how crazy a person is, and how many laws they pass a person who wants a gun can get one. No one is going to know your crazy unless you tell them. How many people are going to do that?
